None appears for the petitioner when the matter is called. 3.

Sri S. K. Das, learned counsel appears on behalf of the Opposite Party-Commissioner.

Perused the prayer whereby the order at Annexure-1 determination of dues under Section -7C of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 is assailed.

It has been stated in the Court Affidavit that without availing the statutory remedy, the petitioner has rushed to this Court.

Taking into account the pleadings on record, this Court is not inclined to entertain this application, giving liberty to the petitioner to move the Appellate Authority, if so advised. In the event, the petitioner moves the Appellate Authority pendency of

the case in this Court may be agitated by filing an appropriate Application.

The writ petition thus stands disposed of.

Urgent certified copy of this order be granted as per rules.
