This matter is taken up through hybrid mode.

Heard Mr. A. Sanganeria, learned counsel for the petitioner and learned Additional Standing Counsel appearing for the State Opposite Parties.

The petitioner has filed this writ petition seeking direction to opposite party No.2- Executive Engineer, Rural Works Division, Deogarh to release outstanding dues and refund all security amount of the petitioner in terms of the representation of the petitioner under Annexure-2 for completion of work i.e. Construction of Odisha Adarsh Vidyalaya (Model School) Building at Bahadaoisu at Barkote Block in the District of Deogarh" vide Agreement No. 41 f2 of 2016-17, within a stipulated period.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation

before the opposite party no.2-Executive Engineer, Rural Work Division, Deogarh vide Annexure-2, and the same may be directed to be disposed of within a stipulated time, to which learned Additional Standing Counsel has no objection. 5.

As agreed by learned counsel for the parties and without expressing any opinion on the merits of the case, we dispose of the writ petition directing opposite party no.2 to consider the representation filed by the petitioner vide Annexure-2 and pass appropriate order in accordance with law within a period of three months from the date of production/communication of certified copy this order. 6.

Issue urgent certified copy as per rules subject to filing of second copy of the writ petition.
