Perused the records. The petitioner has filed this writ petition challenging the order dated 17.05.2011 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.290 (C) of 1996, by which the original application of the petitioner has been dismissed.

Mr. A.K.Mishra, learned Addl. Government Advocate referring to Paragraph-4 of the order passed by the Tribunal contended that since there were four vacancies/posts of Diary Supervisors in accordance with the roster under ORV Rules, 1st and 4th went to reserved category of candidates and two general category candidates have been given promotion in accordance with their merit-cum-seniority. The petitioner was placed at Sl.No.13 of the seniority list and, thereby, no error has been

//2// committed by giving such promotion. Consequentially, he seeks for dismissal of the writ petition.

In view of the above submission, since there is no illegality and impropriety in the order passed by the tribunal, the same requires no interference by this Court.

Accordingly, the writ petition stands dismissed being devoid of merit.
