2. On the oral prayer made by Mr. M. Muduli, learned counsel for the petitioner, he is permitted to implead the Commandant General, Homeguards, Subarnapur as Opposite Party No.5.

3. Learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to approach before Opposite Party No.5. 4.

Considering the prayer made the writ petition is permitted to be withdrawn.

Taking into account the submissions made, the Petitioner is permitted to make an appeal before Opp. party No.5 within a period of three weeks hence.

It is observed that if such an appeal is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No.5 in accordance with law within a period of three months from the date of receipt of the appeal without insisting the delay in filing the appeal.
