Heard learned counsel for the Petitioner.

Referring to the development through inquiry report, Petitioner claims that he has the only passage to the plot involved herein. It is alleged through the application that there is no obstruction to the passage already available to the residence of the Petitioner by the same plot members in the locality.

Considering the serious allegation and as the Petitioner has already made an application to the Competent Authority vide Annexure-5 appears to be pending, this matter stands disposed of directing to Opposite Party No.2 to take a lawful decision by undertaking such exercise within a period of three months from the date of communication of this order and if necessary, involving the parties likely to be affected, if any.
