This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is aggrieved that though, he had applied in terms of the advertisement at Annexure-1 for the post of Junior Clerk (Contractual) and admittedly was placed at serial No.2 in the merit list, and ignoring his legitimate claim the incumbent at serial No.3 was appointed.

It is also further stated by the learned counsel for the petitioner on instruction that the applicant at serial No.1 for the post of Junior Clerk under the U.R. category has been appointed. 5.

On a bare perusal of the advertisement which is the subject matter of the lis, it is seen that there was only one vacancy of Junior Clerk and admittedly the petitioner being at serial No.2 in the merit list, cannot have any claim for the post. Even

otherwise it is seen that the advertisement was for contractual appointment and the age limit fixed was 18 years to 30 years and the petitioner when approached this Court by filing the writ petition on 19.12.2011, his age was above 33 years, as stated in the affidavit.

Taking note of the same, this Court is not inclined to entertain this writ petition.
