This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. (SPL) Case No. 10 of 2021 corresponding to Markatnagar P.S. Case No. 51 of 2021, pending on the file of the learned District & Sessions Judge, Cuttack for the alleged commission of offence under Sections-21(b) of the NDPS Act and the petitioner is in custody since 21.03.2021. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge-cumSpecial Judge, Cuttack by Order dtd. 27.04.2021 in G.R. (Special) No. 10 of 2021, the present BLAPL has been filed.

Heard learned Counsel for the petitioner and learned Additional Standing Counsel for the State.

The allegation is that on 21.03.2021 at about 3.14 P.M., the petitioner was apprehended by the police staff and 110 grams of brown-sugar was seized from his possession. 6.

Having regard to the submissions made, the materials on record, the period of detention already undergone and the fact that the seized contraband is less than commercial quantity, being 110 grams of brown sugar, I am inclined to allow the prayer for bail. 7.

Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the conditions that he shall personally appear before the Trial Court on each date of posting of the case without fail.

The BLAPL thus stands disposed of.
