None appears for the petitioner. On earlier occasions when the matter was taken up on 11.01.2012 and 19.01.2012, none also appeared on behalf of the petitioner. Heard Mr. J.P. Patnaik, learned Government Advocate for the State. Perused the record.

Mr. J.P. Patnaik, learned Government Advocate contends that the penalty was imposed due to non performance which is well justified under law. That apart, the lease period has already been over. 4.

Considering the contentions raised by learned Government Advocate since the lease period has already been over and the penalty had been imposed due to non performance of the petitioner, this Court is not inclined interfere with the matter.

The writ petition is accordingly dismissed.
