This application under Section 482 of Cr.P.C. has been filed with a prayer to set aside the order dated 10.02.2021 passed in C.T. Case No. 25 of 2016 by the learned G.N.A.-cum-J.M.F.C., Komna taking cognizance of offence punishable under Sections 409/406/420/109 of IPC against the petitioner and one Tilakram Nial and Kusha Bhoi. Learned counsel for the petitioner files a memo in Court today and also submits that he may be permitted to withdraw this CRLMC and granted liberty to raise all the points before the learned trial court at the time of framing of charge. The said memo be kept on record. Considering the said submission, the CRLMC is disposed of granting liberty to the petitioner to raise all his contentions at the time of framing the charge before the learned trial court. The CRLMC is accordingly disposed of as withdrawn. Urgent certified copy of this order be granted on proper application.
