ORDER (Oral) 10.03.2022 04.

1. This matter is taken up through virtual/physical mode.

2. The petitioner No.1 is the proprietorship concern of Smt. Subhra Das-petitioner No.2, who had availed four term loans and one Cash Credit facility from the State Bank of India, Bhubaneswar. Petitioner No.3 is stated to be a guarantor.

Due to default in payment of installments, the accounts were declared NPA and recovery process under the SARFAESI Act, 2002 (for short "the Act, 2002") were initiated.

3. The present writ petition has been filed challenging the demand notice dated 29th January, 2010 and notice dated 11th of May, 2011 issued under Section 13(2) and 13(4) of the Act, 2002 respectively.

4. At the time of hearing, learned counsel for the petitioner prays for permission to withdraw the writ petition.

5. In view of the above, the writ petition is dismissed as withdrawn.
