1. The challenge in the present appeal is in a limited sphere. It is only to one portion of the impugned order dated 17th August 2016 passed by the learned Single Judge in W.P.(C) No.12270 of 2012 filed by the present Appellant.
2. While disposing of the above writ petition and setting aside the order dated 2nd July 2012, cancelling the drug license issued in favour of the Appellant, an observation had been made that the quashing of the said order would not preclude the State Government from enquiring into the genuineness of the qualification of the Appellant basing on which he was registered in the Pharmacy Council of Orissa as a Pharmacist on reciprocal basis.
3. There has been no stay of the impugned order of the learned Single Judge during the pendency of the writ appeal. If the enquiry
has not yet been conducted, it cannot now be permitted to be conducted after a lapse of six years.
4. Accordingly, to the above limited extent, it is directed that if no enquiry has been conducted so far, it shall not be conducted hereafter. The appeal is accordingly disposed of.
