1. By filing the present petition, the petitioner alleges noncompliance of the order passed by this Court dated 25.10.2017 disposing of W.P.(C) No.22114 of 2017 as well as order dated 19.07.2019 disposing of CONTC No.1926 of 2018 and prays the Court to proceed against the opposite parties as per the provisions of the Contempt of Courts Act.
2. As directed by this Court, the learned Additional Standing Counsel has obtained instruction regarding compliance of the order passed by this Court dated 25.10.2017 disposing of W.P.(C) No.22114 of 2017 as well as order dated 19.07.2019 disposing of CONTC No.1926 of 2018.
3. To fortify his submission, the learned Additional Standing Counsel submits copies of the Memo No.3537 dated 06.12.2022 from the Principal, Shailabala Women's (Autonomous) College, Cuttack to the Director, Higher
// 2 // Education, Odisha dated 06.12.2022 which encloses copy of the pay register having Bill no.70 (2020-21)/ 24.06.2022. In the said letter, the following has been stated regarding compliance of the earlier orders passed by this Court :
"The petitioner Sri Dr. Babaji Charan Mohanty, Retd. Reader in Chemistry has already been paid an amount of Rs.1057297 (Rupees Ten lakhs fifty seven thousand two hundred ninety seven) only as per Bill No.70 (2020-21) dated 24.06.2020.
The payment is for the period from 19.11.1989 to December,2005."
4. None appears for the petitioner to controvert the aforesaid submissions made by the learned Additional Standing Counsel.
5. In considered opinion of this Court, the order 25.10.2017 disposing of W.P.(C) No.22114 of 2017 as well as order dated 19.07.2019 disposing of CONTC No.1926 of 2018 having been complied with, the present contempt petition has been rendered infructuous and the same is dismissed accordingly.
