This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Phulbani Town P.S. Case No.83 of 2020 corresponding to C.T. Case No.29 of 2020 pending in the Court of learned Special Judge - cum- Sessions Judge, Phulbani for commission offence punishable under section 20(b)(ii)(C) of the NDPS Act. The petitioner moved an application for bail before the Court of learned Special Judge, Phulbani which was rejected on 22.04.2021.

The petitioner was granted interim bail as per order dated 11.08.2021 passed in I.A. No. 646 of

// 2 // 2021 on the ground of ailment of the wife of the petitioner from 13.08.2021 to 06.09.2021. The report of the learned trial Court has come, which indicates that the petitioner after availing the interim bail period has not surrendered for which non-bailable warrant of arrest has been issued against him and also bailor Misc. Case has been started against the bailors and the case has been split up against the petitioner.

Since the petitioner has flouted the terms and conditions of the interim bail order, I am not inclined to entertain this bail application.

Accordingly, the BLAPL stands dismissed.
