Heard Mr. P.C. Nayak, learned counsel for the petitioner and Mr. P.P. Mohanty, learned Addl. Govt. Advocate for the State.

The petitioner has filed this writ petition seeking direction to opposite party no.1 to dispose of its representation under Annexure-8 and grant extension of time with price escalation, as per office memorandum/circular of Works Department, Government of Odisha dated 19.11.2019 to complete the balance work i.e. "Construction of H.L., Bridge over river Zeera of 3rd Km. of Gandhi Chowk to Ambapali-Amedkar Chowk via Thana Chowk in the district of Baragarh under NABARD Assistance RIDF-XXII" in respect of Agreement No.13 P1 of 2018-19 within a stipulated period.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before opposite party no.1-Commissioner -cum- Secretary, Works Department, Government of Odisha vide Annexure-8, and the same may be

directed to be disposed of within a stipulated time taking into consideration the office memorandum/circular of Works Department, Government of Odisha dated 19.11.2019, to which learned Addl. Govt. Advocate has no objection. 5.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.1 to consider the representation filed by the petitioner vide Annexure-8 and pass appropriate order taking into consideration the office memorandum/circular of Works Department, Government of Odisha dated 19.11.2019, as early as possible preferably within a period of three weeks from the date of production of certified copy of this order.

Issue urgent certified copy as per rules.
