This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Registry is called upon to detag the BLAPL No. 4459 of 2022 from BLAPL No. 4547 of 2022.

The petitioner is an accused in G.R. Case No.129 of 2022, on the files of J.M.F.C. Barbil, arising out of Rugudi P.S. Case No.13 of 2022, under Sections 407/420/120-B and 34 of IPC and is in custody since 18.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sesions Judge, Champua, by order dated 16.04.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that the coaccused has been released on bail by this Court by order dated 06.07.2022 in BLAPL No.5280 of 2022.

On perusal of the rejection order, it is seen that petitioner is prima facie similarly circumstanced with the co-accused and taking note of filing of charge sheet from the order of this Court adverted to herein above, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter including that the petitioner shall furnish cash security of Rs.50,000/-(Rupees Fifty Thousands Only) which shall be kept short terms interest bearing account pledged to the Court and which shall be the subject to the final outcome of trial and further directed that the petitioner shall appear before the trial Court on each date of posting without fake.

It is needless to state that violation of any of the condition shall entail cancellation of bail.

Accordingly, the BLAPL stands disposed of.
