Heard learned counsel papering for the petitioner. Order No.

It is alleged that in spite of OPP Appeal No.128 of 2019 pending with the appellate authority, there is attempt of the original authority for eviction of the petitioner. For the opinion of this Court, once appeal is pending, unless the appeal is finally concluded, there cannot be eviction undertaken involving the party involved therein. In the process, this Court while protecting the petitioner till disposal of the appeal directs the appellate authority to conclude the appeal at least within a period of three months from the date of communication of an authenticated copy of this order by the petitioner. Petitioner is directed to serve a copy of this order on the appellate authority and take the date of hearing.
