This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

None appears for the Petitioner at the time of call, so also no one had appeared on last two dates on 17.08.2022 and 16.09.2022, however, Mr. Radheshyam Chimka, learned Senior Standing Counsel is present for Opposite party-Union of India. It appears from the CRLMC application that the Petitioner has challenged the proceeding in 2 (c) C.C. Case No. 43 of 2012 pending in the file of learned Additional Chief Judicial Magistrate(Special court), Cuttack and this CRLMC was filed way back on 13.08.2015. The Criminal Proceeding is pending since 2012 and in the meanwhile, around ten years have passed.

In view of the above facts, especially when no one had appeared today and earlier on two occasion, it pre-supposes that the Petitioner is not interested to prosecute the mater. 4.

Hence, this CRLMC is dismissed.
