This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.185 of 2022, on the files of learned J.M.F.C. at Jatni of Khordha district, arising out of Info Valley P.S. Case No.59 of 2022, under Sections 342/365/395 of the IPC and is in custody since 14.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-IV, Bhubaneswar, by order dated 25.04.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner relies on the order passed by this Court dated 17.05.2022 in BLAPL No.3542 of 2022 by which co-accused one Sashikant Satapathy was released on bail.

It is submitted that since the petitioner is similarly placed, his bail application is to be favourably considered. 7.

Learned counsel for the State relying on the materials on record states that the petitioner is not similarly circumstanced. 8.

Taking note of submission of learned counsel for the petitioner and in view of the release of the accused, this Court directs the petitioner to be released on bail. Terms to be fixed by the learned Court in seisin over the matter including that the petitioner shall appear before the jurisdictional Police Station once in 15 days. Violation of conditions relating to appearance shall entail cancellation in accordance with law without further reference to this Court.

Accordingly, the BLAPL stands disposed of.
