Heard learned counsel for the Petitioner.

The Petitioner admitting that he has been unauthorisedly constructed a house for accommodating himself and the family members but over the land of the Paradeep Port Trust. The Petitioner has even undertaken to vacate the land but once some breathing time is given. In the process, the Petitioner comes up with a proposal at least to accommodate him for four months. The Petitioner has also made a request to the Port Trust Authority asking for six months' time to arrange an alternative accommodation and vacate the land. 3.
Considering the genuine request of the Petitioner and as this Court finds, the Petitioner is in occupation of the plot as a residence to accommodate his family members, considering the undertaking also keeping in view the plight of the owner of the property, this Court in disposal of the Writ Petition observes, in the event the
// 2 // Petitioner files an affidavit to vacate the disputed land at least within a period of three months from today, the Paradeep Port Trust Authority shall do well at least in accommodating the Petitioner for three months.
