This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.

The petitioner is an accused in G.R. Case No.43 of 2021, on the files of learned S.D.J.M., Patnagarh, arising out of Belpada P.S. Case No.9 of 2021, under Sections 420/34 of the IPC and is in custody since 06.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Patnagarh by order dated 12.05.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the statement of one of the witnesses Rajat Sabar and basis of implication being primarily based on co-
accused statement and taking note of release of co-accused Kapil Ray, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 6.
Accordingly, the BLAPL application stands disposed of. 7.
