This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. No. 877 of 2022 on the files of S.D.J.M. Kendrapada, arising out of Marsaghai P.S. Case No.127 of 2022, under Sections 493/471/294/506 of IPC and is in custody since 12.10.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kendrapara, by order dated 17.05.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

Considering the submissions made at the bar that charge sheet has already been filed in the meanwhile and the petitioner is in custody since 12.10.2021, this Court directs the petitioner to be

released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
