This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioner is an accused in G.R. Case No.163 of 2022 on the files of learned SDJM, Banki, arising out of Baideswar P.S. Case No.63 of 2022 under Sections 452/380/34 of IPC and is in custody since 03.04.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Cuttack by order dated 17.05.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations which are triable by Magistrate First Class and the period of custody, it is

directed that the petitioners shall be released on bail on such terms to be fixed by the court in seisin of the matter. 6.

It is submitted by the learned counsel for the petitioner that the petitioners have no criminal proclivity. While enlarging the petitioner on bail the learned court below shall very such assertion. If it comes to the fore that the petitioners have any criminal antecedent this order shall stands recalled.

The present BLAPL is disposed of accordingly. 8.
