Krushna Chandra Swain v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No. 4609 of 2022 Krushna Chandra Swain & Anr.
....
Petitioners Mr. J. Sahoo, Advocate -Versus - State of Odisha ....
Opp.Party Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA ORDER_ 21.10.2022 1.
This matter is taken up through hybrid mode.
Order No.
3.
2.
Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.
3.
The petitioners are in custody since 07.04.2022 in connection with Khurda P.S. Case No.145 of 2022 corresponding to G.R. Case No.463 of 2022 pending in the Court of learned S.D.J.M., Khurda for the alleged commission of offence under Sections 323/324/325/307 of IPC read with Section 75 of J.J. Act.
4.
Considering the nature of accusations and the existence of materials prima facie in support thereof, I am not inclined to enlarge the petitioner on regular bail. However, considering the submissions that the petitioners are required to attend to their family properties which is in danger of being dissipated because of their incarceration, I am inclined to take a lenient view disposing of the bail application with a direction to the court in seisin over the matter to release the petitioner on interim bail for a period of three months from the date of his
actual release on such terms and conditions as he may deem fit and proper to impose.
5.
BLAPL is disposed of accordingly.
