This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.20 of 2022, on the files of learned Sessions Judge-cum-Special Judge, Koraput at Jeypore, arising out of P.R. No.08/2022-23 of Borigumma Excise station, under Sections 20(b)(ii)(B) of the NDPS Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Court of the Sessions Judge-cumSpecial Judge, Koraput, Jeypore, by order dated 06.05.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the petitioner that the contraband seized is to the tune of 2kg.500gms as reflected in

the order of the learned Sessions Judge impugned herein dated 06.05.2022.

Learned counsel for the State opposes the prayer. 7.

On perusal of the order of the learned Special Judge, it is seen that it is specifically observed that there is no material on record to indicate that the present petitioner was involved in other similar cases.

Taking into account the quantity of contraband seized and the period of custody, this Court directs the petitioner to be released on bail, on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
