This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

In the course of hearing, learned counsel for the Petitioner prays to dispose of the CRLMC with grant of liberty to the Petitioner to file a fresh petition in the learned Trial Court for sending the cheques in question to hand writing expert and in that event, the order passed by the learned J.M.F.C., Chandikhole earlier should not stand in the way of disposal of said petition since no reason has been assigned while passing the impugned order.

In view of the aforesaid submission and taking into consideration the impugned order passed on 24.09.2014 indicating no reasoning therein, this Court without expressing any opinion on merit of the case disposes of this CRLMC with liberty to Petitioner to approach the Court in seisin of the case afresh for sending the cheques to hand writing expert and in that event, the earlier order passed on 24.09.2014 shall not stand in the way for considering such
