This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. No. 83 of 2022 on the files of J.M.F.C., Madanpur Rampur, arising out of Madanpur Rampur P.S.
Case No.55 of 2022, under Sections 376(2)(n)/313/323/506/34 of IPC and is in custody since 17.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhawanipatna, by order dated 25.04.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.
It is submitted that charge sheet has already been filed on 28.04.2022.

Considering the tenor of 164 Cr.P.C. statement and keeping in view the period of custody since 17.03.2022 and filing of charge sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
