This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.36 of 2022, on the files of learned Special Judge, POCSO-cum-Sessions Judge, Nayagarh, arising out of Gania P.S. Case No.24 of 2022, under Sections 376AB/506 of IPC and Section 6 of POCSO Act. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge under POCSO Act, Nayagarh, by order dated 29.04.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioners submits that in the 164 statement, petitioners have not alleged any overt act against the
petitioner, so as to implicate him for committing the offences as alleged.

Learned counsel for the State submits that in the meanwhile charge sheet has already been filed. 7.
Considering the 164 statement of the victim, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter.

Accordingly, the BLAPL stands disposed of.
