This matter is taken up throug0h hybrid mode. 2.

Heard learned counsel for the petitioners and learned counsel for the State.

Name of Mr. J. Sahoo and associates be deleted. 4.

The petitioners are accused in G.R. Case No.46 of 2022, pending on the files of learned J.M.F.C. Barpali, arising out of Barpali P.S. Case No.47 of 2022, under Sections 307/326/506/34 of IPC and is in custody since 05.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bargarh, by order dated 05.05.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the submission of the learned counsel for the state that the injury on the head is stated to be grievous has been caused by petitioner No. 1-Dillip Kumar Bishi, this Court is not

inclined to entertain this bail application of Petitioner No.1 at this stage.

It shall be open to the Petitioner No.1 to move this Court at a later point of time if so advised.

8.

Taking into account the period of custody and the role ascribed to the petitioner Nos.2 and 3, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
