Heard Mr.M.Pagal, learned counsel for the petitioner and Mr.Nanda, learned Addl. Government Advocate. 2.

Mr.Nanda, learned Addl. Government Advocate on instruction submits that upon completion of investigation in connection with Ersama P.S. Case No. 25 of 2022 registered under Sections 498-A, 302/34 I.P.C. read with Section 4 of the Dowry Prohibition Act, 1961 charge sheet No. 178 dated 27.5.2022 under Sections 498-A, 306, 406/34 I.P.C. read with Section 4 of the D.P. Act has already been filed before the jurisdictional Court against Jyoti Ranjan Das, Bira Das and Padmabati Das. 3.

Mr.Pagal, learned counsel for the petitioner submits that since the accused persons have not been charge sheeted for higher offences and since the other accused persons whose names are there in the F.I.R. have not been charge sheeted, he submits that liberty may be granted to

// 2 // the petitioner to file a protest petition before the jurisdiction Court.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a protest petition before the jurisdictional Court. It is made clear that in case such a petition is filed, the jurisdictional Court is directed proceed with the same in accordance with law. 5.

The CRLMP is accordingly disposed of.

Urgent certified copy of the order be granted on proper application.
