This matter is taken up through Hybrid Mode.

The present writ application has been filed challenging levy of tax and penalty by the Regional Transport Authority.

So far as imposition of penalty is concerned, the matter is appealable U/s.13(2) of the Odisha Motor Vehicle Taxation Act. The petitioner is agreeable to pay the tax demanded and propose to prefer appeal against the order imposing penalty.

In view of the facts and submissions and the nature of relief sought for, the writ application is disposed of directing the petitioner to pay the tax component as demanded, within a period of four weeks from today and he may prefer appeal and file show-cause U/s.13(2) of the Odisha Motor Vehicle Taxation Act, so far as imposition of penalty is concerned. On payment of tax component, the Fitness Certificate and Permit be granted in favour of the petitioner.

So far as appeal is concerned, if there is any delay in filing the appeal, the same be condoned liberally, as the matter was pending before this Court.
