2. Learned counsel for the petitioner contended that the petitioner filed appeal on 31.08.2010 before the appellate authority under Rule 64 (4) of the Orissa Minor Mineral Concession Rule, 2004 which is annexed as Annexure-4 to the writ petition and the same is pending consideration.

Mr. T.Pattnaik, learned Addl. Standing Counsel contended that if such appeal is pending, direction may be given to dispose of the said appeal in accordance with law.

Having heard learned counsel for the respective parties and after going through the record, this writ petition is disposed of with a direction to the opp. party No.1 to consider the appeal filed by the petitioner as above in accordance with law, preferably, within a period of two months from the date of production of this order. 5.

Issue urgent certified copy as per rules.
