Heard learned counsel for the parties.

3. The Petitioner is aggrieved by the notice dated 21.05.2022 issued by the Opposite Party No.4Tahasildar, Rajnagar under Annexure-1 with a direction on the Petitioner to vacate the encroached land by 25.05.2022.

Since the said action of the Tahasildar, Rajnagar is an appealable one, this Court is not inclined to entertain with the same. However, it is observed that if the Petitioner prefers an appeal within a period of seven days and files an interim application along with that, the Appellate Authority shall take a decision on the said interim application within a period of two weeks from the date of receipt of the said application. Till such a decision is taken by the Appellate Authority, no coercive

// 2 // action shall be taken against the Petitioner in the above noted case.
