The petitioner is an accused of G.R. Case No.1476 of 2020, on the file of learned SDJM, Kendrapara, arising out of Patkura P.S. Case No.248 of 2020 under Sections 341,294,323, 325, 427, 380, 302 and 34 of IPC.

Perused the statement of the wife of the deceased Ayusmini Mishr@Mohanty. Taking into account the nature of the allegations and the overt act attributed to the petitioner in view of the order passed by this Court relating to the co-accused Kaminikanta Mishra dated 07.07.2021 in BLAPL No.3672 of

// 2 // 2021. This Court is not inclined to exercise its jurisdiction under 439 Cr.P.C.
