This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This is an application U/S. 439 of Cr.P.C. by the Petitioner for grant of bail in connection with Bisra P.S. Case No.164 of 2020 corresponding to S.T. Case No.39 of 2021 pending in the Court of learned 1st Addl. Sessions Judge, Rourkela for commission of offence punishable U/S. 302 of the I.P.C. on the allegation of committing murder of his parents.

In the course of hearing of the bail application, Mr.S.K.Dash, learned counsel for the petitioner submits that the petitioner is a paralysis patient and all the allegations appearing against him is frivolous and false and the petitioner having detained in judicial custody since 25.12.2021 may kindly be released on bail. 4.
On the contrary, Mr.S.S.Pradhan, learned counsel for the State by drawing attention of the Court to the deposition of P.W.1 submits that the petitioner is the principal accused and he has committed the murder of his mother and, therefore, the petitioner may not be released on bail.

Considering the rival submissions made and taking into
// 2 // consideration the allegations on record against the petitioner for committing murder of his parents and the evidence of witnesses examined so far by the learned Trial Court including the evidence of P.Ws. 1 and 2 in support of the allegations against the petitioner, this Court does not find any reason to grant bail to the petitioner. Hence, the prayer for bail of the petitioner stands rejected. 6.
Accordingly, the BLAPL stands disposed of.

Urgent certified copy of the order be granted on proper application.
