1. Heard Mr. K.K. Mishra, learned counsel for the Appellant, Mr. B.P. Tripathy, learned A.G.A. for the State-Respondent No.1 and Mr. P.K. Mohanty, learned Senior Counsel for the Bhubaneswar Municipal Corporation-Respondent Nos.2 to 4.

2. The issue is relating to violation of approved plan and Orissa Development Authority Act and Rules.

3. Learned Single Judge while disposing of the writ petition has remanded back the matter to the authority concerned by directing for re-adjudication of UAP Case No.10 of 2021 and to dispose of the same within a period of four months and till then to maintain status-quo by both parties.

4. It is the admitted case of both the parties that pursuant to the direction of the learned Single Judge, the Appellant has

approached the authority concerned and participating in the proceeding.

5. Thus considering all such factors and particularly the issues involved, we are not inclined to interfere with the order of the learned Single Judge.

6. The Writ Appeal is dismissed.
