The Petitioner in this writ petition prays for a direction to the Opposite Parties to restore power supply to the house of the Petitioner standing over Plot No.1347 and also for a direction to dispose of the appeal filed by her under Section 127 of the Electricity Act, 2003 (for short 'the Act'). 3.

Mr. Dash, learned counsel for the Opposite PartiesTPCODL submits that the appeal under Section 127 of the Act is pending before the Assistant General Manager (Electrical), Kendrapara Electrical Division No.1, TPCODL-Opposite Party No.2. Thus, a direction may be issued to dispose of the appeal at an early date.

So far as restoration of power supply is concerned, Mr. Dash, learned counsel for the Opposite Parties-TPCODL submits that power supply to the residence of the Petitioner

// 2 // standing over Plot No.1347 was disconnected on the allegation of bypass. Unless the appeal is decided, no fresh power supply can be given to that plot. The land in question is 'Jalasaya' kisam as recorded in the R.O.R. It is a matter of enquiry as to whether other residences standing over the said plot have been provided with electricity or not. As such, he submits that disposal of the appeal at an early date will resolve the entire issue.

Taking into consideration the submissions made by learned counsel for the parties, this Court without expressing any opinion on the merits of the case of the Petitioner in the appeal filed under Section 127 of the Act disposes of this writ petition with a direction that on production of certified copy of this order within a period of two weeks hence, Assistant General Manager (Electrical), Kendrapara Electrical Division No.1, TPCODL-Opposite Party No.2 shall do well to consider and dispose of the appeal within a period one month therefrom. The Petitioner is also at liberty to pray for restoration of power supply to her residence before the appellate Authority. Urgent certified copy of this order be granted on proper application.
