3. The petitioner in the writ petition alleges inaction of the opposite party no.4-Executive Engineer, Keonjhar Municipality for removal of alleged unauthorized construction of residential house made by the Opp.

Party No.5 to over the plot No.1599/1725, Khata No.443/32, Mouza-Atoper Badapokharitala, Tahasil/PS-Keonjhar Sadar, DistKeonjhar. 4.

It is submitted by the learned AGA that as stated in the writ petition, there is a approved plan which has been deviated by the opposite parties 5 to 9 during construction on the plot. It is further submitted that the petitioner has to move the appropriate authority in accordance with law for redressal of his grievances i.e.

// 2 // deviation from the approved plan during construction. 5.

Learned counsel for the petitioner fairly submits that he may be permitted to withdraw the writ petition to approach the authority in accordance with law. 6.

Having heard learned counsel for the petitioner as well as learned AGA for opposite parties 1 to 3, the writ petition is disposed of at the stage of admission without issuing notice to opposite parties 4 to 9 with the following order:- The petitioner shall move the authority for redressal of his grievances regarding the deviated construction within a period of two weeks. The authority shall consider the same in accordance with law after granting due opportunity of hearing to the affected/interested parties and pass orders accordingly.

Issue urgent certified copy as per rules.
