1. This matter is taken up through hybrid mode. Order No.

2. The petitioner has filed the writ petition with the following prayer:

"It is therefore, most respectfully prayed that, this Hon'ble Court may graciously be pleased to:- A. Admit this writ petition.

B. As to why the opposite parties more particularly the District Education Officer-opposite party nos.3 and 5 shall not be directed to provide the death benefits under the Insurance and the Provident Fund along with other benefits of the deceased son of the petitioner since 01.07.2016, and, C. And as to pass such other order or orders as this Hon'ble Court deem fit and proper.

And on their failure to show cause or showing in sufficient cause, this Hon'ble Court be pleased to make the said Rule absolute by way of issuing appropriate writ or writs, order or orders in the facts and circumstances of the present case."

3. Heard learned counsel for the petitioner and the learned Additional Govt. Advocate.

4. Learned counsel for the petitioner fairly submits that he has received the amount of Rs.8,00,000/- as mentioned in Annexure-7 through Demand Draft bearing No.050312 drawn on State Bank of India, Dakshin Dhamara.

5. Learned counsel further submits that regarding the other statutory claims under the provisions of Employees' Provident Funds and Miscellaneous provisions Act as well as Workmen's Compensation Act, he may be given liberty to withdraw the writ petition and move the appropriate authority.

6. The writ petition is accordingly disposed of as withdrawn with the liberty as prayed for.
