BLAPL No.4677 of 2022 Santosh Bhoi ....

Petitioner Mr.T. Barik, Advocate -versusState of Odisha ....

Opp. Party Mr.Arupananda Das, Addl. Government Advocate

CORAM:

JUSTICE S.K. SAHOO Order No.

ORDER

25.11.2022 I.A. No. 2039 of 2022 04.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application for modification of the order dated 26.10.2022.

It appears that this Court while rejecting the bail application as per order dated 26.10.2022 directed the learned Court below to commit this case to the Court of Session, expeditiously if there is no other impediment, in the event of which the learned trial Court shall frame the charges at the earliest and proceed to examine the material witnesses and the petitioner was given liberty to renew his prayer for bail after examination of the material witnesses in the learned trial Court. Learned counsel for the petitioner submits that in spite of the aforesaid order dated 26.10.2022, till date the case has not been committed to the Court of Session.

In view of the aforesaid submission, I am not inclined to modify the order dated 26.10.2022. However, the petitioner is

// 2 // at liberty to renew his prayer for bail before the learned trial Court.

The I.A. stands disposed of.
