This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Parties.

3. The Writ Petition has been filed with the following prayer:- "(i) Admit and allow the writ application.

(ii) Call for the records.

(iii) Issue Rule NISI calling upon the opp. parties as to why the Departmental Proceeding vide No.1467/03 pending before the Collector, Puri shall not be quashed / or targeted to dispose of the same within every short time and the same is pending in the court since 2003 completing more than 18 years and in case opp. parties are failed to counter or insufficient counter, make the rule absolute by passing any other writ/writs in nature of.

(iv) To pass an order by directing B.D.O., Delanga to dispose of show cause dated 5.5.2022 followed by the Petitioner for getting salary from 15.02.2019 till 31.12.201.

(v) To pass any order for fixation of pay or revise of the same for the suspension period i.e. 27.12.2003 to

// 2 // 9.3.2005 the date of reinstatement with payment of full salary and revise scale of pay to avail from 6th and 7th pay commissioner benefit.

And pass any order / orders / direction in favour of the petitioner with early conclusion of suspension order / period vide Annexure-3".

He further submits that through highlighting his grievances, the petitioner has filed a representation on 05.05.2022 under Annexure-4 to the Writ Petition before the opposite party No.7 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party no.7 to take a decision on the above noted petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.7 to take a decision on the above noted petition in accordance with law within a period of one month from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.
