This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Bhawanipatna Sadar P.S. Case No.100 of 2022 corresponding to C.T. Case No.341 of 2022 pending in the Court of learned S.D.J.M., Bhawanipatna for commission of the alleged offences punishable under sections 341/323/324/307/427/ 506/34 of the Indian Penal Code.
Perused the first information report annexed to the anticipatory bail application.
// 2 // As it appears that the petitioner earlier approached this Court for anticipatory bail, which was dismissed as per the order dated 19.04.2022 mainly on the ground that the petitioner is having four criminal antecedents and it is a case under section 307 of the Indian Penal Code.
Mr. Manas Chand, learned counsel for the petitioner produced the affidavit of the petitioner from which it appears that in all those four cases, the petitioner has been released on bail and the offences are triable by Magistrate. Learned counsel for the petitioner submitted that in view of the nature of accusation in the four criminal antecedents, the anticipatory bail application of the petitioner may be favourably reconsidered.
Learned counsel for the State opposed the prayer for anticipatory bail.
Considering the submissions made by the learned counsel for the respective parties and in view of the earlier order passed, while not inclining to reconsider the prayer for anticipatory bail, it is observed that in the event the petitioner surrenders and moves for bail in the Court below within a period of four weeks from today, the same shall be disposed of by the learned Courts below in accordance with law expeditiously. The case records along with up-to-date case diary and injury report shall be made available to
// 3 // the Court concerned for adjudication of the bail application.
The ABLAPL stands disposed of.
