This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with G.R. Case No.23 of 2015 arising out of Jajpur Sadar P.S. Case No.03 of 2015 pending in the Court of learned S.D.J.M., Jajpur for alleged commission of offences under sections 365/376/511/ 323/506/34 of the Indian Penal Code.
Perused the F.I.R.
It is a case of the year 2014.
It appears that the petitioner earlier approached
// 2 // this Court for anticipatory bail application in ABLAPL No.1109 of 2015 and ABLAPL No.1762 of 2015. The fact regarding filing of the earlier bail application by the petitioner has not been reflected anywhere in this application rather in the cause title, it is mentioned that "the matter out of which this bail application arises was never before this Hon'ble Court in any manner whatsoever as per instruction of the petitioner".
In view of such state of affairs, I am not inclined to release the petitioner on anticipatory bail. Accordingly, the ABLAPL stands dismissed.
