This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). This is an application for modification of the order dated 21.06.2022.
Learned counsel for the petitioner submitted that some of the co-accused persons have been released on anticipatory bail, and therefore, the claim of parity with the co-accused persons may be taken into account at the time of adjudication of the bail application.
Learned counsel for the State has no objection.
// 2 // Considering the submission of learned counsel for the petitioner, it is directed that in the event the petitioner surrenders in the Court of learned S.D.J.M., Bhubaneswar in C.T. Case No.4521 of 2015 within the time stipulated as per order dated 12.08.2022 in I.A. No.987 of 2022 and moves for bail, the same shall be disposed of as expeditiously as possible by the Courts below preferably on the same day in accordance with law and the claim of parity with the co-accused persons, who are stated to have been released on anticipatory bail, shall be taken into account at the time of adjudication of the bail application. The rest part of the order dated 21.06.2022 which was modified on 12.08.2022 remains unaltered. The I.A. is accordingly disposed of.
