1. The present petition under Section 11 of the Arbitration and Conciliation Act, 1996 ('Act') seeks the appointment of an Arbitrator to adjudicate the disputes between the Petitioner and the Opposite Party arising out of an agreement dated 3rd July, 2019 for sale and purchase of the property mentioned under the schedule of this petition.

2. The learned Mediator has submitted a failure report on 20th April, 2022.

3. With consent of learned counsel for the parties, the Court appoints Mr. Justice A.S. Naidu, Former Judge of this Court as the sole Arbitrator to adjudicate the disputes between the parties. All the contentions of the parties including the question of maintainability, claims and counter claims are left open to be urged in the arbitration proceedings in accordance with law. The

arbitration shall take place under the aegis of the High Court Arbitration Centre.

4. The arbitration petition is disposed of accordingly. A copy of this order be communicated to the learned Arbitrator forthwith.

5. An urgent certified copy of this order be issued as per rules. (Dr. S. Muralidhar) Chief Justice S.K. Jena/Secy.
