This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with T.R. Case No.32 of 2020 arising out of Umerkote P.S. Case No.212 of 2021 pending in the Court of learned Addl. Sessions Judge, Umerkote for offences punishable under sections 20(b)(ii)(C) and 29 of the N.D.P.S. Act.

The prayer for bail of the petitioner was rejected by the learned Addl. Sessions Judge, Umerkote vide order dated 05.05.2022.

// 2 // In view of availability of criminal antecedent against the petitioner that too under the N.D.P.S. Act, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail stands rejected. The learned trial shall do well to split up of the case against the co-accused persons, who are absconding and make every endeavor to conclude the trial of the petitioner within a period of six months from the date of framing of charge. The petitioner is at liberty to renew his prayer for bail if the trial is not concluded within the aforesaid period. The BLAPL is accordingly disposed of.

A copy of the order be communicated to the learned trial Court for compliance.
