This matter is taken up through hybrid mode.

The Petitioner being in custody in S.T. Case No.02 of 2015, arising out of Jagannath Prasad P.S. Case No.151 of 2013, pending in the court of Additional Sessions Judge, Bhanjanagar, has filed this petition for his release on bail. The offences alleged against him are punishable under Sections 302, 201, 120-B read with Section 34 of the I.P.C. 3.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party. 4.

Considering the delay in disposal of the aforesaid case and the fact that nine witnesses have been examination in the

// 2 // meanwhile, so also the fact that Petitioner stated to be in custody since the date of his arrest, i.e., from 25th December, 2013, notwithstanding the seriousness of the allegation that he stated to have been committed murder of his brother, this Court directs that the Petitioner be released on bail in the aforesaid case by the Court in seisin over the matter on such terms and conditions as it would deem just and proper.

Accordingly, the BLAPL stands disposed of being allowed.
