1. Heard Mr. Mishra, learned counsel for the Petitioner and Mr. Samantray, learned Additional Government Advocate for the State.

2. Mr. Mishra submits that he is ready to pay the entire dues pending against him as on date and to prefer appeal in terms of Rule 46 OMMC Rules, 2016 within fifteen days from today.

3. Accordingly, the writ petition is disposed of with a direction that in the event the Petitioner prefers appeal within two weeks from today, his appeal shall be disposed of in accordance with law by the Appellate Authority as expeditiously as possible preferably not later than 30th September 2022. If the Petitioner deposits the entire dues outstanding against him as on date within

such period to be directed by the Appellate Authority, then the quarry in question shall not be leased out to any other person till disposal of the appeal.

4. Urgent certified copy of this order be granted on proper application.
