ORDER

1. Heard Mr. N.K. Barik, learned counsel for the Petitioner and Mr. B.S. Rayaguru, learned CGC for Union of India - Opposite Parties 1 to 5.

2. Present Petitioner has come up against the retrospective promotion given to private Opposite Parties 6 and 7 under Annexure-11, which is also the subject matter of challenge before the learned Central Administrative Tribunal in O.A. No.260/139 of 2022 at the instance of the petitioner. Learned Central Administrative Tribunal by interim order dated 13th May, 2022 under Annexure-13 has observed that said impugned order under Annexure-11 shall always be subject to the result of the O.A.

3. Therefore the challenge of the petitioner against the same order is not found maintainable in the present writ petition. Since the O.A. is pending before the learned CAT, we are not inclined to entertain the present writ petition.

4. Accordingly, the writ petition is dismissed.

5. It is clarified that this Court has not expressed any opinion on the merits regarding Annexure-11.

6. Issue urgent certified copy as per rules.
