This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State. This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Motonga P.S. Case No.71 of 2022 corresponding to G.R. Case No.361 of 2022 pending in the Court of learned S.D.J.M., Dhenkanal for alleged commission of offences under sections 341/379/324/34 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the offences are triable by Magistrate and therefore, the bail application of the petitioner may be

// 2 // favourably considered.

Learned counsel for the State, on the other hand submitted that the case has turned to one under section 307 of the Indian Penal Code and the injured is one Shranta Rout and he has sustained grievous injuries.

Considering the submissions made by learned counsel for the respective parties, the nature of accusation and the injury sustained by the injured, while not inclining to release the petitioner on anticipatory bail, it is ordered that in the event the petitioner surrenders and moves for bail before the learned Court below within a period of four weeks from today, the same shall be disposed of as expeditiously as possible by the Courts below and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case records be made available before the Courts concerned for adjudication of the bail application.

The ABLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
