Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 500 of 2022 arising out of Kendrapara Sadar P.S. Case No. 109 of 2022 on the file of learned SDJM, Kendrapara, registered for the alleged commission of offence under Sections 341/ 323/ 324/ 307/ 294/ 506/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge, Kendrapara by order dated 9.05.2022, the present BLAPL has been filed 5.

Considering the submission of the learned counsel for the petitioner that the Charge-Sheet has already been filed inter alia under Section 307 of the I.P.C. and keeping in view the statement of the injured Shiba Prasad Das and keeping in view the genesis of the offence and the relationship between the petitioner and injured, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
